This website is operated by Inkoop en Verkoop Turnhout, a vennootschap onder firma incorporated under Dutch law, with its registered address at De Wagenmaker 31, 5506CP Veldhoven, the Netherlands, registered with the Dutch Chamber of Commerce (Kamer van Koophandel) under number 96274190 and with RSIN 867541155, trading online as Fairspil ("Fairspil"). The company is represented by its authorised partners, Ied Mohammad Sultani and Tabsera Sultani Sultani.

 

Throughout the website, the terms "we", "us" and "our" refer to Fairspil. Fairspil offers this website, including all information, tools and services available from this website, to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

 

Fairspil sells second hand goods. Every mirror and every decorative item offered on this website has been previously owned and used. Please read Section 4 carefully, as it explains what that means for the condition of the items you buy.

 

 

SECTION 1. WEBSITE USE

 

By accessing or using any part of this website, you agree to be bound by these Website Terms of Use, including any additional terms, conditions and policies referenced here or available by hyperlink. These Website Terms of Use apply to all users of the website, including without limitation browsers, vendors, customers, merchants and content contributors. If you do not agree to these Website Terms of Use, you may not access the website or use any of the services it offers.

 

By agreeing to these Website Terms of Use, you confirm that you are at least the age of majority in your country of residence, or that you are the age of majority in your country of residence and you have given us your consent to allow any of your minor dependants to use this website.

Occasionally there may be information on our website that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information on the website is inaccurate at any time without prior notice, including after you have submitted your order.

 

We undertake no obligation to update, amend or clarify information on the website, including pricing information, except as required by law. No specified update or refresh date applied on the website should be taken to indicate that all information on the website has been modified or updated.

 

 

SECTION 4. SECOND HAND PRODUCTS AND PRODUCT CONDITION

 

All items offered on this website are second hand. They are previously owned and previously used goods, sold in the condition described in the relevant product listing.

 

Because our items are not new, signs of age and use are normal and expected. This may include foxing or spotting in mirror glass, wear or loss of gilding, scratches, chips, small repairs carried out before or after the item came into our possession, discolouration, and other marks. These characteristics are part of the item and are not considered defects.

 

Each item is unique and available in a single quantity. Photographs on the website show the actual item offered for sale and are not stock images, although colours may appear differently depending on your screen. We describe the condition of each item as accurately as we reasonably can, and we photograph visible flaws rather than concealing them. If you would like additional photographs or information about the condition of a specific item before ordering, please contact us and we will provide it.

 

Nothing in this section affects your statutory rights as a consumer under Dutch law, including your right to receive an item that conforms to its description.

 

 

SECTION 5. ORDERS, PRICES AND PAYMENT

 

All prices shown on the website are in euros and include Dutch VAT where applicable. Shipping costs are shown separately during checkout before you complete your order.

 

An order is accepted once we confirm it by email. Because every item exists only once, it is possible that an item is sold or otherwise unavailable after your order has been placed. If that happens we will inform you as soon as possible and refund any amount already paid in full.

 

We reserve the right to refuse or cancel any order, to limit quantities, and to cancel orders that in our judgement appear to be placed by dealers, resellers or distributors, or that appear fraudulent.

 

 

SECTION 6. SHIPPING AND DELIVERY

 

We ship to addresses in the Netherlands only. We do not deliver to any other country. Orders are dispatched from our locations in Germany or France.

 

Two shipping options are available at checkout:

 

Free shipping, with an expected delivery time of 4 to 5 business days.

Insured express shipping at 4.95 euro, with an expected delivery time of 2 to 3 business days.

 

Delivery times are counted in business days from the moment your order has been dispatched and are estimates rather than guaranteed dates. Delivery may take longer during busy periods or as a result of circumstances outside our control, such as carrier delays, weather or strikes.

 

Risk of loss and damage passes to you once the item has been delivered to the address you provided. Because our items are fragile by nature, please inspect the packaging on arrival and report any damage to us as soon as possible, with photographs of both the item and the packaging.

 

You are responsible for providing a complete and correct delivery address. We are not liable for orders delayed or lost as a result of an incorrect or incomplete address.

 

 

SECTION 7. RIGHT OF WITHDRAWAL AND RETURNS

 

As a consumer you have the right to withdraw from your purchase within 14 days of receiving your order, without giving a reason. To exercise this right, inform us within that period by email at info@fairspil.com. You then have a further 14 days to return the item.

 

Returned items must be sent back in the condition in which they were received and, where reasonably possible, in the original packaging. You are responsible for any loss in value resulting from handling beyond what is necessary to establish the nature and characteristics of the item. The cost of returning the item is borne by you unless we have agreed otherwise or the item was not as described.

Certain content, products and services available through our website may include materials from third parties. Links on this website may direct you to websites that are not affiliated with us. Fairspil, its partners, employees and affiliates will not be held liable for any damages arising from your use of the website or from any errors, interruptions or delays in its functionality, to the extent permitted by law. This limitation does not apply in cases of intent or deliberate recklessness on our part, nor does it affect our liability under mandatory consumer law.

The content of this website, including but not limited to text, product photographs, images, videos, logos and graphics, is the intellectual property of Fairspil or its licensors. Our product photographs are taken by us of items in our own possession. You may not use, reproduce or distribute any of this content without our prior written consent.

You agree to indemnify and hold harmless Fairspil, its partners, employees, agents, service providers and affiliates from any demand, loss, liability, claim or expense, including reasonable legal fees, made against us by any third party arising out of or in connection with your use of the website in breach of these Website Terms of Use.
